I am hesitant to say for sure without knowing the laws of your state, but it sounds like you have a good chance to me since they broke the lease. Make sure you have signed copies of the lease and print outs of the e-mails when you go to court.
I have everything all together already. I contacted the District Attorney's office this morning & they advised me to send a registered letter to the tenant re: the NSF check as this large amount constitutes check fraud. Apparently anything that comes back NSF for over $1000 is considered a felony in the state of MI. If I don't receive payment in full within 5 business days, I'm supposed to go to my local police department & file charges.
They say the check fraud / passing a bad check with such a high value is of more concern to them as it could be ruled a criminal matter.
