this has been discussed at length on my local board as well.
whenever there is a tragedy and a post gets a lot of responses, such as phillyandashley's loss, it becomes a "hot topic" below. Why do they not filter/check their hot topics so that someone's personal tragedy is not showcased as a 'hot topic'

I don't think that it's that they don't care. The forums are basically a web application. There's probably a default that says "if a post gets x views and/or repsonses in x time, it's a hot topic". I would think though that they can manually remove those types of posts, but it may take some development work.
I do see your point though.
