Another FMLA/OFLA Question..

My 12 weeks of maternity leave will be over about mid-July. I'm thinking of taking a new job which will begin at the end of August/beginning of September. Just checking to see if anyone knows what would happen if I decide not to go back to my current job after maternity leave. Do I have to pay for insurance that was covered during leave? What about short term disability pay? We will have to either pay COBRA for insurance during the month of August or find something else to cover us for that month, but I'm okay with doing that...I'm just worried about insurance coverage during maternity leave...

  • You need to check with your HR (or look in your manual) because it is likely you will be required to pay back your benefits.  However, you would not be responsible for repaying your STD.

  • Definitely check with your HR, as this probably is different for each workplace. My handbook states that if I return to work after my unpaid maternity leave (amazing, right?) for at least 30 days, then I am not required to pay anything back. 

    I don't think this has to be an awkward conversation with HR. Just go into your meeting stating that you'd like to know the outcome of each scenario so that you and your partner can make the best decision for your family.

  • You could go back in and give your two weeks on first day back...just an idea they may let you go immediately.
  • Okay, thanks for the replies!! I checked out policies, and it looks like they could ask me to pay back premiums. But I'm allowed to save 40 hours of leave, so I could use that for one week and work one week.
