Generally, a CS modification can only be done if the change will be 20% (at least in CA). If the CS hasn't been modified in at least a year, it doesn't hurt to have it looked at.
By using your State's CS agency, they can immediately begin a wage garnishment even if the CS order doesn't get modified. You'll get your payments more timely, and the CS agency will keep records of missed payments, interest, etc. I think an extra $250 a month is worth modifying the CS.
Question though: why is BD paying childcare costs if you are a SAHM?

I think she means he was paying less child support because they factored in he was paying child care costs. Now that she SAH and he isn't paying child care costs he wont get that deduction on the CS calculator. Also it sounds as though her and her H are paying the insurance costs so that will also go in their favor in the CS calculator.
OP, I would go ahead and do what your lawyer suggested.

Got it.
Be prepared for BD to fight to cover the health insurance though. If he's able to get health insurance through his employer, there's an excellent chance that it can be ordered that he maintain the insurance. If you really like DS' pedi, you might want to consider negotiating with BD for a slightly lower CS rate so that he doesn't push to handle the insurance (my sister did this with her ex several years ago).
Yes, when the original order was made BD was paying for child care. Plus we are paying for insurance now so we should get that credit. The order is a couple years old and the change is more than 20%.
