  Excerpt:

   

  Death or birth of child.   A child who was born or died during the year is treated as having lived with you all year if your home was the child's home the entire time he or she was alive during the year. The same is true if the child lived with you all year except for any required hospital stay following birth.

   

  Not sure if this is different if you are divorced, share custody, or whatever though.

  My DD was born in November 2010 and we were able to claim her for the whole year on our 2010 taxes.

  My friends lo was born Dec 28th and she was able to claim him. My understanding was that events that happened prior to dec 31 count for taxes

  If you child is under a year old, you can claim them for the calendar year they were born in. The living requirement is more for who has the right to claim the child if you are not 'married filing jointly'.
